Agreement to Terms
Welcome! This Terms of Use Agreement ("Agreement") describes the terms and conditions of your relationship with Pay & Slay AI ("Company," "we," "us," or "our"). This Agreement applies to your use of our website and services, including any application programming interfaces (API) we may offer (collectively, the "Service").
READ THIS AGREEMENT CAREFULLY.
IT GOVERNS YOUR ACCESS AND USE OF THE SERVICE AND APPLIES TO ALL USERS. BY ACCESSING OR USING THE SERVICE IN ANY WAY, YOU REPRESENT THAT: (1) YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THIS AGREEMENT, (2) YOU ARE AT LEAST 18 YEARS OLD AND OF LEGAL AGE TO FORM A BINDING CONTRACT WITH COMPANY, AND (3) YOU ARE NOT BARRED FROM USING THE SERVICE UNDER APPLICABLE LAWS.
If you do not agree to be bound by the terms of this Agreement, you may not access or use the Service.
Service Description
Pay & Slay AI is an AI-powered platform that generates images and videos based on user-provided prompts. Our platform operates on a pay-per-generation model. Each generation is a separate transaction.
Use of the Service
Subject to your compliance with this Agreement, Company grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business purposes only.
Account Registration
You must be at least 18 years old to create an Account. You are responsible for all activities under your Account. You shall not share your login credentials with anyone. You agree to provide accurate, current, and complete information during registration and maintain it. You are responsible for monitoring your Account and restricting use by individuals under 18.
Payment Terms
Payment Processing:
- All payments are processed securely through Razorpay. We do not store your full credit card details
- By providing payment information, you authorize us to charge your payment method for each generation
- Payment is due in full at the time of each generation request
- You agree that Company is authorized to charge your payment method immediately
Multi-Currency & Pricing:
- Prices are displayed in your local currency based on your geolocation
- Currency conversion is handled by Razorpay using real-time exchange rates
- You are responsible for any currency conversion fees imposed by your bank or payment provider
- Company reserves the right to change pricing with at least 14 days' notice
Tax Compliance
VAT/GST is calculated and added based on your billing country. You are responsible for understanding and complying with applicable tax laws. Tax invoices are available through your payment bill.
6.1 ADDITIONAL NOTICE FOR INDIAN USERS — DIGITAL PERSONAL DATA PROTECTION ACT, 2023
If you are located in India, we process your personal data as a “Data Fiduciary” under the Digital Personal Data Protection Act, 2023 (“DPDP Act”). We collect and process your data only for the specified purposes described in this Policy, based on your consent or another lawful ground recognized under the DPDP Act. You have the right to access, correct, and erase your personal data, to withdraw consent at any time, and to nominate another individual to exercise your rights on your behalf in the event of death or incapacity. You may also file a complaint with the Data Protection Board of India if you believe your rights have been violated. Our support team can be reached at support@payandslay.ai.
6.2 ADDITIONAL NOTICE FOR EUROPEAN (EEA/UK) USERS
If you are located in the European Economic Area or United Kingdom, our legal bases for processing your personal information include: performing our contract with you (delivering the Service you requested), our legitimate interests (such as securing and improving the Service), compliance with legal obligations, and your consent where required. You have the rights described above, as well as the right to lodge a complaint with your local data protection supervisory authority.
6.3 ADDITIONAL NOTICE FOR U.S. STATE RESIDENTS
If you are a resident of California or another U.S. state with a comprehensive privacy law, you may have the right to know what personal information we collect and share, to request deletion or correction, and to opt out of the sale or sharing of personal information and targeted advertising. As stated in Section 5, we do not sell or share your personal information for cross-context behavioral advertising.
Refund Policy
Automatic Refunds:
- If a generation fails for any reason, you will receive an instant automatic refund via Razorpay
- Refunds are processed within 2-7 business days
Manual Refund Requests:
- You may request a refund within 24 hours of generation if unsatisfied with quality
- Contact support@payandslay.ai with your generation ID
- We reserve the right to deny frivolous or repeated refund requests
Ownership
Your Content Ownership:
- Company does not claim ownership of your inputs or generated outputs ("Outputs")
- You retain all ownership rights to generated images and videos
- You may use, modify, distribute, and commercialize Outputs freely
- You grant Company the right to use your inputs and Outputs to train and improve our AI models
Company Ownership:
- All intellectual property rights to the Service are owned exclusively by Company
- You may not reproduce, modify, distribute, or create derivative works without written permission
User Conduct and Restrictions
You agree NOT to use the Service for any of the following:
- Creating illegal, explicit sexual, or adult content
- Generating content that infringes third-party intellectual property or copyrights
- Creating deepfakes, non-consensual intimate content, or identity fraud materials
- Generating content for harassment, bullying, defamation, or hate speech
- Creating content that promotes violence, terrorism, or illegal activities
- Using the Service for fraud, scams, or deceptive purposes
- Attempting to reverse-engineer or exploit the platform or APIs
- Misrepresenting that Outputs are human-generated when they are not
- Circumventing safety systems or content moderation through prompt injection or jailbreaking
Violations may result in immediate account suspension or permanent termination without refund. We reserve the right to report illegal activity to authorities.
Monitoring and Content Removal
Company may monitor and filter the Service for compliance with this Agreement. We reserve the right to remove, refuse to process, or suspend any content that we determine to be objectionable, unlawful, or inconsistent with this Agreement without prior notice. Company may also disclose your information to third parties if we believe your content violates their rights or if required by law.
Warranty Disclaimers
THE SERVICE (INCLUDING ANY OUTPUT) IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Company further makes no warranty that:
- Outputs will be original, unique, accurate, or error-free
- Output quality will meet your expectations
- Third-party AI APIs will be available without interruption
- The Service will be secure, uninterrupted, or error-free
- Outputs are suitable for any particular purpose or use case
Limitation of Liability
IN NO EVENT SHALL COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF SUCH DAMAGES.
COMPANY'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC GENERATION IN QUESTION.
Indemnification
You will indemnify and hold Company harmless from any losses, costs, or liabilities (including attorneys' fees) arising from: (i) your content or use of Outputs; (ii) your misuse of the Service; (iii) your violation of this Agreement; (iv) your violation of any rights of others; (v) your violation of applicable laws; or (vi) disputes with third parties related to your use.
Service Availability & Uptime
- We aim for high availability but provide NO service level agreements (SLAs) or uptime guarantees
- Scheduled maintenance may cause temporary interruptions
- Our Service depends on third-party AI APIs which may experience outages
- We are not liable for service interruptions caused by third-party providers
- In case of API failure, payment is voided and automatic refunds are issued
Changes to Service & Terms
- Company reserves the right to modify features, models, or pricing at any time
- Major changes will be announced at least 30 days in advance
- We may update these Terms by posting the updated version online
- Continued use after updates constitutes acceptance of modified Terms
Account Termination
By You:
You may terminate your account at any time by contacting support@payandslay.ai.
By Company:
- We may terminate your account immediately if you violate this Agreement
- Accounts involved in fraud or illegal activity will be terminated without refund
- We may discontinue the Service at our discretion
Third-Party Services
The Service may contain links to third-party websites and services that are not under our control. Company is not responsible for third-party content, terms, or policies. You use all third-party services at your own risk. When you leave our Service, this Agreement no longer governs.
Governing Law & Disputes
This Agreement is governed by applicable law in your jurisdiction. All disputes related to this Agreement or your use of the Service shall be resolved through negotiation or mediation. If unresolved, disputes may be brought in the courts of your country of residence.
Intellectual Property Infringement
If you believe your work has been infringed, please contact support@payandslay.ai with a detailed description, location of the infringing content, and good-faith statement that the use is unauthorized.
